TERMS OF SERVICE

Welcome to ETHDO.ME 2025 (referred to herein as “ETHDO.ME” or the “Event”), a gathering of Web3 builders, designers, developers, and enthusiasts. ETHDO.ME 2025 is a sub-event taking place within ETHDenver 2025(“ETHDenver”). By participating in ETHDO.ME in any capacity—attendee, volunteer, exhibitor, speaker, mentor, sponsor, judge, media, or otherwise—you acknowledge and agree that your participation is also subject to ETHDenver’s Terms of Service, as well as these ETHDO.ME Terms of Service (“Terms”).

These Terms form a legally binding agreement between you (“you,” “your,” or “participant”) and ETHDO.ME and its affiliates, assigns, or partners (collectively, “we,” “us,” or “our”), and govern your use of or access to:

  • Our website, ethdo.me (the “Site”),
  • Our affiliated online channels or services,
  • Any side events or programs we may host during ETHDenver 2025.

Where there is a conflict or inconsistency between these Terms and ETHDenver’s Terms of Service, the ETHDenver Terms of Service will control, as ETHDO.ME is part of ETHDenver 2025.

By clicking “I Accept,” registering for ETHDO.ME, or otherwise participating, you confirm that you have read and understood these Terms and ETHDenver’s Terms and agree to be bound by them. If you do not agree, you may not attend or use ETHDO.ME’s services.

ARBITRATION NOTICE: Unless prohibited by local law, disputes arising under these Terms (except as described in Section 11) are resolved by binding, individual arbitration, and you and ETHDO.ME each waive the right to a trial by jury or to participate in any class action or representative proceeding.Please carefully review Section 11 for details.

1. Relation to ETHDenver 2025

1.1 ETHDenver 2025 Terms of Service

  • ETHDO.ME is organized as a sub-event within ETHDenver 2025. You agree that your participation in ETHDO.ME is also governed by ETHDenver’s Terms of Service and related policies, which are incorporated by reference into these Terms.
  • If any provision in these ETHDO.ME Terms conflicts with the ETHDenver Terms, the ETHDenver Terms will govern.

1.2 Eligibility

  • To attend ETHDO.ME, you must be eligible under ETHDenver’s rules (e.g., age restrictions) and must not be suspended or otherwise barred from ETHDenver.
  • You represent that you meet ETHDenver’s eligibility requirements and have not been removed or banned from any previous ETHDenver or related events.

1.3 Event Location

  • ETHDO.ME will be held as a part of ETHDenver 2025, currently scheduled for February 23 – March 2, 2025, at the National Western Complex and other official ETHDenver venues throughout Denver, Colorado (the “Venue”).

2. Registration and Admission

2.1 Registration Process

  • To participate in ETHDO.ME, you must register through our Site or via ETHDenver’s registration portal (as applicable). You will receive confirmation of your participation by email.

2.2 Membership or Ticketing

  • ETHDO.ME may be included in ETHDenver’s free community-member admission if you join the associated DAO or membership program (e.g., SporkDAO), or it may require a separate ticket purchase. If a separate ticket is required, the purchase is non-refundable and non-transferable unless otherwise stated.

2.3 Accurate Information

  • All participants must provide truthful, up-to-date information. Any misrepresentation, such as identity or professional status, can result in revocation of your registration or expulsion.

2.4 Badge and Credentials

  • As ETHDO.ME is part of ETHDenver, you may receive a single badge for all ETHDenver 2025 activities, or a supplementary ETHDO.ME badge. You must wear your badge visibly at all times at the Venue and may not share or transfer it without explicit permission from an event organizer.

2.5 Opt-In for Information Sharing

  • If you opt in during registration, ETHDO.ME and ETHDenver may share limited registration details with official sponsors or partners for networking or marketing purposes, in accordance with our Privacy Policy and ETHDenver’s Privacy Policy.

3. Code of Conduct

3.1 Code of Conduct Applies

  • ETHDO.ME adopts the ETHDenver Code of Conduct. You agree to review and follow all behavioral and safety standards outlined in ETHDenver’s Terms and Code of Conduct, including prohibitions on harassment, discrimination, and other disruptive behaviors.

3.2 Additional ETHDO.ME Policies

  • We emphasize collaboration, respect, and community. Harassment, hate speech, intimidation, stalking, or any conduct that endangers others is strictly prohibited.
  • If you witness or experience violations, please report to an ETHDO.ME or ETHDenver staff member or volunteer immediately.

3.3 Drugs, Alcohol, Weapons

  • ETHDO.ME adheres to the same restrictions on drugs, alcohol, and weapons as ETHDenver. You may not bring your own alcohol or any weapons to the Venue. Illicit drug use is strictly prohibited.

3.4 Violations

  • Violation of any Code of Conduct terms may result in immediate expulsion from ETHDO.ME and potentially from ETHDenver 2025, without refund.

4. Intellectual Property and Project Ownership

4.1 Your Creations

  • You retain ownership of the original code, designs, and other content you create during ETHDO.ME. However, you acknowledge that any relevant third-party licenses or terms (e.g., software libraries from ETHDenver sponsors) also apply.

4.2 Open Collaboration

  • ETHDO.ME encourages sharing and open collaboration. Any ideas, concepts, or information you choose to disclose to others at ETHDO.ME or ETHDenver are at your own discretion. You are responsible for protecting confidential information or trade secrets.

4.3 Trademarks

  • “ETHDO.ME,” the ETHDO.ME logo, and any related marks are our property. The “ETHDenver” name and marks are the property of ETHDenver or its affiliates. You may not use these marks without explicit written permission from the respective owner.

5. Fees and Purchases

5.1 Fees

  • ETHDO.ME may or may not charge separate fees apart from ETHDenver’s. If fees are charged, all purchases are final unless otherwise stated in writing. We reserve the right to adjust fees at any time.

5.2 Payment Processors

  • Payments for ETHDO.ME may be handled by ETHDenver’s or a third party’s payment processor. You agree to their terms and policies.
  • We are not liable for processor errors or issues, but we will make good-faith efforts to resolve payment disputes.

5.3 Prizes and Taxes

  • If ETHDO.ME offers prizes, you acknowledge prizes may constitute taxable income. You are responsible for any reporting or tax obligations. ETHDO.ME may require KYC and other documentation before awarding prizes.

6. Event Recording and Likeness

6.1 Recording

  • ETHDO.ME activities (talks, workshops, hacking sessions) may be recorded or photographed by official organizers or sponsors. By participating, you grant ETHDO.ME and ETHDenver the right to record and use your image, voice, and likeness for event-related promotional or archival purposes.

6.2 Ownership and Use

  • All event footage (video, audio, photographs) is owned by us or our licensors. You waive the right to review or receive compensation for appearances in any promotional materials.

7. User Content

7.1 Posting and Sharing

  • You may post content (e.g., on social media walls or message boards) relating to ETHDO.ME. You must ensure you have the rights to the content you post.

7.2 License to Use

  • By posting or displaying content relating to ETHDO.ME, you grant us and ETHDenver a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display your content for event promotion or communications.

7.3 Inappropriate Content

  • We reserve the right to remove or limit access to any content that violates these Terms, the ETHDenver Terms, or the spirit of the event.

8. Limitations of Liability; Assumption of Risk

8.1 Disclaimer

  • ETHDO.ME is provided on an “as is” and “as available” basis. To the fullest extent allowed by law, we disclaim warranties of any kind, including implied warranties of merchantability or fitness for a particular purpose.

8.2 Limitation of Liability

  • In no event will ETHDO.ME, ETHDenver, or our affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, even if advised of such possibility.
  • Where liability cannot be excluded, it is limited to the amount you paid (if any) for ETHDO.ME attendance.

8.3 Assumption of Risk

  • By attending, you acknowledge inherent risks of in-person events (including travel, crowd-related risks, exposure to illness, etc.). You assume these risks voluntarily.

8.4 Indemnification

  • You agree to defend, indemnify, and hold harmless ETHDO.ME, ETHDenver, our sponsors, partners, and affiliates from any claim, suit, or liability arising from:
    1. Your use or misuse of the Event or Venue,
    2. Your violation of these Terms, or
    3. Your infringement of third-party rights.

9. Under-18 Participants

9.1 Minors

  • If you are under 18, you may attend ETHDO.ME only with verifiable parental or guardian consent, in compliance with ETHDenver’s policies. Minors must be accompanied by a parent or guardian at all times.

9.2 Liability

  • Parents or guardians of minors are liable for any damages, losses, or injuries caused by the minor.

10. Privacy and Data Protection

10.1 Privacy Policy

  • Our Privacy Policy (and ETHDenver’s Privacy Policy) govern how we collect, store, and use your data. By participating, you consent to these privacy practices.

10.2 Third-Party Tools

  • We may use third-party software or analytics on the Site. Any data handled by third parties is subject to their privacy terms. We are not responsible for their practices, but we strive to work with reputable providers.

11. Dispute Resolution and Arbitration

11.1 Arbitration Requirement

  • Except as outlined below or prohibited by applicable law, any dispute arising under these Terms will be resolved via binding arbitration administered by a recognized arbitration provider (e.g., JAMS).

11.2 Exceptions

You or ETHDO.ME may seek:

  • Small claims remedies if the claim qualifies,
  • Injunctive relief in a court of law in aid of arbitration,
  • Resolution for an intellectual property infringement claim in a court of competent jurisdiction.

11.3 Opt-Out

You may opt out of this arbitration agreement within 30 days of first agreeing to these Terms by sending a written notice stating your full name and the email associated with your registration to:

11.4 Class Action Waiver

  • You may bring disputes only on your own behalf, and not as part of a class, consolidated, or representative action, unless both you and ETHDO.ME specifically agree otherwise.

11.5 Governing Law

  • These Terms and any disputes will be governed by the laws of the State of Colorado, without reference to conflict of law principles, and subject to ETHDenver’s governing law clause if you remain within ETHDenver’s broader Terms.

12. Miscellaneous

12.1 Entire Agreement

  • These Terms, along with ETHDenver’s Terms of Service and our Privacy Policy, comprise the entire agreement concerning your ETHDO.ME participation. No other agreements or understandings, oral or written, apply.

12.2 Severability

  • If any provision of these Terms is deemed unenforceable, the remainder will remain in full force.

12.3 No Waiver

  • Failure to enforce a provision is not a waiver of our right to do so later.

12.4 Modification

  • We may update these Terms. Changes become effective immediately upon posting, unless otherwise specified. Continued participation in ETHDO.ME after changes signifies acceptance of the revised Terms.
